The ex-lawyer for the former president has stepped down as New Jersey's top federal prosecutor. This decision was prompted by a legal ruling that challenged her eligibility to serve.

The head of the Justice Department, the Attorney General, announced her stepping down on Monday. In a statement that the court's "flawed" ruling made it unworkable for her to effectively run her office.
"Do not interpret adherence to the ruling as defeat," Habba stated. "This battle will now extend throughout America."
Judicial Challenge
The departure was triggered by a federal appellate panel determined that she had been serving in violation of the law as US attorney. This decision is likely to affect many prosecutions in the state.
The appellate judges declared that a interim role that bypassed the advice and consent of the Senate breached the Federal Vacancies Reform Act.

Habba, originally became part of Donald Trump's lawyers in 2021. Subsequently, she represented her client in his business records case in 2024, when he was guilty verdict on dozens of charges of falsifying business records.
Earlier, her appointment to the federal prosecutor position, Donald Trump had announced he was selecting her as his White House advisor if re-elected, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
