A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was detained in federal detention.

In her decision, the judge noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
